* Report Delayed Due to Recent Hostilities
The Tax Freedom 101 Report was to go out Tuesday evening, but due to the recent attack we were delayed. The following report is what was to be sent out Tuesday evening. Items shown in red are items occurring after this Tuesday's report date. We apologize for the delay.

* Back to School, and Back to Work
Now that summer is over, or at least "Labor" Day has past, people can once again focus clearly on the issues important to restoring our Republic. We debated over whether to continue publication of the Tax Freedom 101 Report through the month of August, but since most people tend to be preoccupied with summer and the activities associated with such as the season comes to a close we decided to focus our efforts in other areas.

We have kept track of the events and news that have occurred over the past month however, and compiled some of the more intriguing articles in the news section. Tyranny certainly has been busy, and "they" never seem to rest, therefore nor should we. September should prove to be another interesting month as many involved in the Constitutional Revival Movement prepare for hearings on Capitol Hill. If the powers that be in media decide to cover the event it should raise some eyebrows and possible some consciousness to our mutual plight among the not so well informed citizenry.

Don't bank on the government to do the right thing, nor the Constitutional Revival Movement to make large strides after these hearings, but rather watch and learn about the political process as these events unfold. The Tax Freedom 101 Report will be there to provide details as the battle for freedom continues.

The Law Never Changes, but Languages Do

It is a fact that the intent of the Framers, when they wrote the Constitution, was that it never change except by amendment. However, when the meanings of the words used therein are changed, unscrupulous judges and politicians can "interpret" or "reinterpret" any provision thereby perverting the intent of the Framers. To put it another way, legislative intent never changes - but languages do.

To demonstrate this truth, let us examine Section 2, Clause 3

"The Trial of all Crimes, except in Cases of Impeachment, shall be by Jury"

This seems pretty strait-forward - right? Apparently not. There is much confusion today over what this clause means, and all this confusion arises because most people do not know what the intent of the founding fathers were when they guaranteed us the right to trial by "jury" in the constitution.

Black's Law Dictionary (6th Ed.) defines the term, "jury" in part, as,

"A jury is a body of persons temporarily selected from the citizens of a particular district, and invested with the citizens of a particular district, and invested with power to present or indict a person for a public offense, or to try a question of fact. See also Trier of fact."

The definition actually covers an entire page, but nowhere in the definition does it state that the jury may judge an issue of law. This causes many people to believe that when the founding fathers [framers] wrote the constitution, that they did not intend for a jury to ever determine an issue of law, and that this duty was solely that of the judge.

But is this what the founding fathers intended? To determine this, all we need do is to look the word "jury" in a dictionary of that era. The best dictionary for this purpose is Noah Webster's American Dictionary of the English Language, (1828):

"Jury, n. A number of freeholders selected in the manner prescribed by law, empanelled and sworn to inquire into and try any manner of fact, and to declare the truth on the evidence given them in the case. Petty juries, consisting usually of twelve men, attend courts to try matters of fact in civil causes and to decide both the law and the fact in criminal prosecutions. [Emphasis mine]

So, when the founding fathers [framers] wrote the Constitution, they meant for the jury to judge both the law and the fact! Thus, it would appear that any law could be changed by changing the meaning of words; but this is not so. In our constitutional republic, it is the intent of the law that is the force of the law; and it was clearly the intent with the founding fathers that juries decide the law as well. This is called "jury nullification."
