The 1st Labor Day - September 5th, 1882 - 118 Years Ago Today!
The first Labor Day was declared on Tuesday, September 5, 1882, 118 years ago in New York City, in accordance with the plans of the Central Labor Union. The Central Labor Union held its second Labor Day holiday just a year later, on September 5, l883.


In l884 the first Monday in September was selected as the holiday, as originally proposed, and the Central Labor Union urged similar organizations in other cities to follow the example of New York and celebrate a "workingmen's holiday" on that date. The idea spread with the growth of labor organizations, and in l885 Labor Day was celebrated in many industrial centers of the country.

Labor Day Legislation
Through the years the nation gave increasing emphasis to Labor Day. The first governmental recognition came through municipal ordinances passed during 1885 and 1886. From them developed the movement to secure state legislation. The first state bill was introduced into the New York legislature, but the first to become law was passed by Oregon on February 2l, l887. During the year four more states -- Colorado, Massachusetts, New Jersey, and New York -- created the Labor Day holiday by legislative enactment. By the end of the decade Connecticut, Nebraska, and Pennsylvania had followed suit. By 1894, 23 other states had adopted the holiday in honor of workers, and on June 28 of that year, Congress passed an act making the first Monday in September of each year a legal holiday in the District of Columbia and the territories.

Labor Day, a holiday celebrated in most industrialized nations to honor working men and women was devised mainly by trade unions and Socialists as sponsored by the Second Socialist International. Labor Day was observed in the U.S. on the first Monday in September to reject any identification with Socialists or Communists; now a general holiday in North America, while Europe still devotes it to working class.

MAY DAY - The Real Labor Day
May 1st, International Workers' Day, is recognized in every country except the United States, Canada, and South Africa. This despite the fact that the holiday began in the 1880s in the United States, with the fight for an eight-hour work day. In 1884, the Federation of Organized Trades and Labor Unions passed a resolution stating that eight hours would constitute a legal day's work from and after May 1, 1886. The resolution called for a general strike to achieve the goal, since legislative methods had already failed. With workers being forced to work ten, twelve, and fourteen hours a day, rank-and-file support for the eight-hour movement grew rapidly, despite the indifference and hostility of many union leaders. By April 1886, 250,000 workers were involved in the May Day movement.

* The Social "Security" Protection Act of 2000
Misuse, abuse, loss of privacy, surveillance, fraud, illegal activities, identity theft, stalking, and other violent crimes are a result of wide spread use and dissemination of the Social Security Number. Will this Act protect those who continue to make use of the Social Security number? We don't believe so. Here is why. This Act, parts of which we will analyze for the benefit of our readers later in this article is designed to do one thing, protect the social security system. The government has a vested interest in keeping its customers from damage when using their [the governments] numbers. We will remind our readers that the the SSN is not your number, it's their [the governments] number. They have millions of them. They assigned one to you presumably because you asked for one. If it was your number you wouldn't have needed to ask for it, would you? Actually the SSA assigns numbers under one of two conditions which we will review later.

So lets begin analyzing this Bill H.R. 4611 which charges the federal government:

"To strengthen the authority of the Federal Government to protect individuals from certain acts and practices in the sale and purchase of Social Security numbers and Social Security account numbers, and for other purposes."

Sounds straight forward enough. 1.) Strengthen authority of the Fed. Gov. 2.) "protect" individuals from certain acts and practices in the sale of SSN and SSAN's, and 3.) and for "other" purposes. Now let's read on in Section 2 FINDINGS Part (3) it states:

Section 2 FINDINGS Part (3): The Federal Government requires virtually every individual in the United States to obtain and maintain a Social Security number in order to pay taxes, to qualify for Social Security benefits, or to seek employment.

Interesting language used indeed. Why the words "virtually every individual" in the first sentence? Why not just the two words "every individual"? I guess the adverb "virtually" implies that there are some who are not obtaining and maintaining an SSN. Are these people privileged souls, or elite politicians who are exempt from being required to obtain and maintain an SSN? No. The are just common folks who know the laws, and have chosen not to participate. Simply they have learned that there is no law required to participate in the Social Security "system" for citizens. The FINDINGS of the Bill go on to say in Part 3:

"An unintended consequence of these requirements is that Social Security numbers have become tools that can be used to facilitate crime, fraud, and invasions of the privacy of the individuals to whom the numbers are assigned."

Unfortunately for the government (IRS, SSA) and their customers (unwitting citizens) there have been "unintended" consequences (read competition) for misuse of their (the governments) numbers. However we would argue, after fully investigating the history of Social Security, that it was an intended consequence that these numbers would become tools to facilitate crime (theft), fraud (concealment of the facts and constructive fraud) and invasions of privacy (violations of citizens 4th and 5th Amendment rights) by the very government charged with protecting life, liberty, and property. Continuing on:

"Because the Federal Government created and maintains this system, and because the Federal Government does not permit persons to exempt themselves from those requirements, it is appropriate for the Government to take steps to stem the abuse of this system."

It is more than appropriate, it is imperative that the Government take steps to stem the abuse of this "system", or else they will lose more customers (Taxpayers). It is true that the Fed. Gov. does not permit "persons" to exempt themselves from duly enacted laws. There are actually "persons" who are defined to whom these requirements listed at the beginning of the FINDINGS do apply. Those requirements being, listed in order of importance: to pay taxes, to QUALIFY for Social Security benefits, or to seek employment. The real question is, who is the "person" to whom they refer and what exactly are their requirements? It is those "persons" who have obligations and responsibilities under the law that's who. When you discover the entire meaning behind the definitions of the words used in the FINDINGS, those being: individual, person, and employment you will learn that there can be no exemptions. The question again is are you the "person" to whom the Act is intended?

SEC. 3. DEFINITIONS. (2) Person.--The term ``person'' means any individual, partnership, corporation, trust, estate, cooperative, association, or any other entity.

Whoa. Which person are you? The privileged entity - a partnership, corporation, trust, estate, cooperative, association created by the state? How about the individual? Are you the individual? Individual what in other words. The legal term individual is also independently defined, but you may be surprised who it is when you read the law. Then of course there is the "any other entity" to cover all the bases. Of course, obfuscation and ignorance play a large part in drafting legislation and in some instances parts from bills which become law need to be omitted due to vagueness in the final codifying of the law. We will explain how and why this is done as you read on.

SEC. 3. DEFINITIONS. (5) Social security number; social security account number.--The terms ``Social Security number'' and ``Social Security account number'' have the meaning given those terms in section 208 of the Social Security Act (42 U.S.C. 408).

Lets back up and visit the Title and Section explaining who is required to have a Social Security Number which is: 42 USC section 405(c)(2)(B)(i). Read this section of the law here, in case you believe we are making this up. Basically and to paraphrase this section: "In carrying out the Commissioner's duties... account numbers will be assigned to... (I) aliens at the time of their lawful admission to the United States... and (II) to any individual who is an applicant for or receipt of benefits..." Those are the two provisions to whom SSN's and SSAN's are to be assigned.

SEC. 3. DEFINITIONS. (6) State.--The term ``State'' means any State of the United States, the District of Columbia, Puerto Rico, the Northern Mariana Islands, the United States Virgin Islands, Guam, American Samoa, and any territory or possession of the United States.

Now we come to jurisdiction. Simply put all jurisdiction is the power, right, or authority to apply the law. So the question is to whom and where can this proposed law be applied? We must reiterate here that obfuscation and ignorance play a large part in drafting initial legislation. What would you expect from representatives who have rarely, if ever, actually read the law. Some of the language used in bills before and after they have been approved may need to be either clarified or omitted due to vagueness. The language used must be brought into conformity with the supreme law of the land the Constitution.

For example: The term "State" above in Sec 3 appears to also include any one of the 50 States of the Union with the clause "means any State of the United States". However it can't, and more than likely won't, when the legislative aids (the people at the Congressional Research Service within the Library of Congress who assist the come-and-go representatives in Washington) finish conforming the final legislation pursuant to Constitutional and lawful requisites. Again definitions play a large part in understanding the limits of jurisdiction. Remember that this bill corresponds to Social Security, and since Social Security is a tax it is directly connected to Title 26 the Internal Revenue Code. There are [15] definitions of the "United States" that apply within the Internal Revenue Code. The reason for the various definitions is that different tax provisions apply in different jurisdictions [geographical locations specified within the law] for the purpose of implementing the INTENT of the Congress as evidenced in the statues enacted pursuant to the Constitution. Congress was forced to create variant definitions of the term "United States" to address the provisions for applying specified tax laws to different pieces of geography. For instance, they may call the continental shelf [the areas adjacent to the mainland or the possessions that are under water and yet within the 12 mile limit] the "United States" for the purpose of limiting the geographical area where certain taxes apply. When a particular piece of geography can be placed within a definition for purposes of clarifying jurisdiction, you will find that it is found readily within the context.

When and if this bill is passed it will be in conformity to the jurisdiction which is granted to the Social Security Administration and the Internal Revenue Service and it will not include any one of the 50 physical geographic States of the Union. This is why, still to this very day, there continues to be no law requiring a Citizen to participate in the Social Security program, and why participation for citizens is totally and wholly voluntary for Citizens. They just don't have jurisdiction unless you give it to them by volunteering (applying) to participate in being taxed.
