A TRULY FREE CHURCH AND MINISTRY UNDER IRS ATTACK "Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof;..." - First Amendment to the Bill of Rights, The Constitution of the United States We rarely run personal stories of distress due to IRS raids in this report, however this one caught our attention, and rightly so. Citizen and creation scientist Dr. Kent Hovind, the unincorporated and truly tax-exempt ministry [not a 501(c)3] known as Creation Science Evangelism [CSE], and the Dinosaur Adventure Land [DAL] theme park have been targets of an ongoing IRS criminal investigation for some time now, and they were recently on the receiving end of an IRS raid lead by CID agent Scott Schneider. Excerpt from: IRS Probes Creationist Theme Park Operator Associated Press "Agents on Wednesday confiscated computer and paper records of financial activity since 1997, but no charges have been filed against Hovind. He denied wrongdoing Friday. In a sworn statement to obtain a search warrant, IRS agent Scott Schneider said none of Hovind's enterprises has a business license or tax-exempt status as a nonprofit entity." Full story here: IRS Probes Creationist Theme Park Operator Unlike the overwhelming majority of faith based or "religious" organizations and institutions that prostrate themselves at the feet of government and ask for a license to exist, and in return receive the privilege to be regulated, censored, and taxed by government, CSE has not. CSE and its missionaries are a true ministry, a free church if you will. As for Dr. Kent Hovind, he is a Citizen of the State of Florida, and he too has not applied for subsidies, welfare programs, and other government "entitlement benefits" associated with the recognized and sanctioned IRS tax-exemption. One of the fundamental legal questions that needs to be answered by the IRS is what law[s] requires Dr. Hovind to apply for such licenses, and the IRS sanctioned tax-exemption as IRS agent Scott Schneider contends? Excerpt from: IRS raids business, home of creationist - Museum owner questions timing Pensacola News Journal "Since 1997, Hovind has engaged in financial transactions indicating sources of income and has made deposits to bank accounts well in excess of $1 million per year during some of these years, which would require the filing of federal income taxes," wrote Schneider. The statement is based on financial records plucked from Hovind's garbage from July 2002 through March 2004, statements from a former employee, Internet research and public records. Hovind, who has not been charged, suspects he is being targeted because of his religious beliefs. He adamantly denies wrongdoing." Full story here: IRS raids business, home of creationist - Museum owner questions timing Dr. Hovind said the IRS raid required a dozen sheriffs, and approximately 20 IRS agents. The surreptitious actions of digging through the Hovind's trash for nearly two years to determine the ministries operating expenditures by using a word that the IRS presumes and conveniently leaves legally undefined as "income" matches their seemingly coincidental tactics of conducting the raid one day before April 15th. The raid occurred during the CSE/DAL staff meeting. A staff which is comprised primarily of Dr. Hovind's family who run the daily operations of the ministry. Dr. Hovind said the agents seized cash from the premises, and that the search warrant listed Dr. Kent Hovind in his personal capacity, the church, and its members as subjects of the investigation. Hovind's lawyer Glen Stoll of Remedies at Law said the Affidavit of Probable Cause for the raid was full of assumptions and hearsay, and that they plan to correct the matter by legal means. The IRS raid and situation is strikingly similar to the raid of the Save-A-Patriot Fellowship in 1993. When all was said and done the judge's final decision on whether the fellowship had to be regulated by the federal government was most favorable. We pray that this too is the case for Dr.Hovind and these ministries. Besides the significance of this case, what it will mean for the future of free churches and the First Amendment, one can only imagine the stress and violation that the Hovind family has endured to date from this terrorist experience, and how much your support would mean to them right now. According to Dr. Hovind CSE and DAL are still in operation, and they can use all the support they can muster to fight these false allegations. In closing, let's not forget who is in control. If it be God's Will that the work of CSE continue then be sure it will. However if it is not to continue let us be comforted with these words: 13: And who is he that will harm you, if ye be followers of that which is good? 14: But and if ye suffer for righteousness' sake, happy are ye: and be not afraid of their terror, neither be troubled; 15: But sanctify the Lord God in your hearts: and be ready always to give an answer to every man that asketh you a reason of the hope that is in you with meekness and fear: 16: Having a good conscience; that, whereas they speak evil of you, as of evildoers, they may be ashamed that falsely accuse your good conversation in Christ. 17: For it is better, if the will of God be so, that ye suffer for well doing, than for evil doing. 18: For Christ also hath once suffered for sins, the just for the unjust, that he might bring us to God, being put to death in the flesh, but quickened by the Spirit: 19: By which also he went and preached unto the spirits in prison; 20: Which sometime were disobedient, when once the longsuffering of God waited in the days of Noah, while the ark was a preparing, wherein few, that is, eight souls were saved by water. - 1st Peter, chapter 3 verses 13-20, KJV Perhaps the Lord is ready for Dr. Hovind to close the door on his Ark of Creation Science Evangelism and Truth in preparation for mans' final judgment. Time will tell, however if we are called to help now, then let's be obedient to that call!
