UPDATES:
- Cooking-the-books, Globally

Everyone should be familiar with the Enron collapse by now, yet is there a pattern of clever accounting tricks up the sleeves of the financial elites as well? This is an update story about the lawsuit of alleged gold fixing by major banking institutions and the global financial cartels, and what may be the beginning of an interesting year in the financial markets. Insight Magazine is picking up this story now, one which we have been following since early last year. The last time we reported on this was in our
January 8th, 2002 edition. Insight Magazine draws some interesting conclusions about the Enron collapse and what is alleged to be happening with the gold markets.

- Constitutional Quiz Question of the Week

"In questions of power, then let no more be said of confidence in man, but bind him down from mischief by the chains of the
Constitution." - Thomas Jefferson

This week's question: In how many ways has the Constitution been expanded beyond its original written form? (hint - at least five ways).

Last week's question: What is the meaning of the phrase "grant letters of marque and reprisal" as found in Article 1, Section 10?

Last week's Constitutional Quiz Question of the Week with answer can be found
here.

Do legal research like a judge (or his clerk):
Did you ever wonder how a judge researches the wide variety of issues
waiting to be ruled on in his court? I did, and after spending numerous
hours in the law library I put what I found out in a professionally
produced 85 minute video. To see sample clips of the video, order one,

NEWS:
- Drag Your Feet Like A Little Brat

What do little children do when they can't have their way, or get caught doing something wrong and want to prolong the inevitable spanking that may follow? Why they throw a tantrum. You may be familiar with the scene. Screaming, they drag their feet as they dangle by the wrist twisting like a broken sign in the wind.
This time the feet dragging is coming from those who got caught in a blatant attempt to squelch the free exercise of the first amendment. Who could it be? You guessed it, the government, our favorite little brat.

Ask Joseph Farah of the online publication World Net Daily what he thinks of the behavior of the Department of "Justice" and the IRS as they drag their feet in retrieving documents requested under discovery motions for their civil suit. The political audit given to the Western Journalism Center of which Farah was involved was put in motion by the politburo under the Clinton Administration. Perhaps if the WJC wasn't a privileged entity accepting "non-profit" status as a 501c(3)/(4) corporation this purely political audit would have never happened, and the time and resources expended to bring about this lawsuit could have been used in a more productive manner. This is what nonprofits can expect when they make application for privileges from government and acquiesce to IRS jurisdiction. I guess we have to blame the CPA's and tax attorneys, as they don't know any better when they advise their new clients to seek these unrequired organizational structures in order to exist.

- The Last Step for World Government

Okay, okay, your right, we already have a world government. Perhaps it is the last step in finalizing the power of the world government however - a global tax. The tax(es) being proposed by the UN, as so many taxes are today will be for what else but wealth redistribution. The main "payer" of the tax will be the country with the reserve currency of the world, the US, or us. Hey it is only fair, why with our worthless paper circulating around the globe we receive the world's wealth for next to nothing. Get ready for another "pay-your-fair-share" tax with no lawful authority behind it as we go kicking and screaming into the new world order.

"UN tax police potential" full story here.

- Show Me the Law

Kenny Weiland, member of The Lunch Band from the "Live Free or Die" state has composed a little ditty [song] called "Show Me the Law". They're of course referring to the tax law. Music is a powerful medium, and although they aren't listed in the Billboard Top 100, you can make them climb to the top of the charts at SoundClick.com by clicking on their song.

Have a listen on-line or download their song in hi-fi MP3 format by going here.

INFORMATION:
- Establishing Intent via Material Facts

Most of our members know, the government relies upon uneducated juries to move forward with willful failure cases. The knowledge and intent of any individual who is made the subject of wrongful prosecution, is kept from the jury lest the facts reveal the limited application of the tax law. The jury, being ignorant of the law, has no other alternative but to base its decision on emotion and/or presumption rather than on the facts that are suppressed by the court. However, "material" facts cannot be suppressed.

So... What are material facts and how are they established? The act of "purchasing"
the SAPF video, and the act of "relying" upon the information contained within, are examples of material facts. The information presented in the video becomes material because it demonstrates the cause of the individual's belief. Therefore, should someone's "intent" ever be brought into question, the purchase of this SAPF video series may be more important than you think, especially if their "understanding" of the law developed from watching the tapes.

According to the supreme Court in the Cheek decision, such information may not be withheld from a jury. If the video resulted in, or formed the basis of their belief then it is admissible as evidence in an action which questions their intent. Under these circumstances, "proof of purchase" may be extremely important. It can show, for example, that they were exposed to certain facts about the law and that those "facts" lead to further research, ultimately resulting in their determination that the law did not require them to file a return. If those "facts" reveal that the law does not require the filing of a return (under whatever application or circumstance they may be examining) then they are material and cannot be withheld from the jury - BUT - the individual must prove that they were exposed to those facts and the date on which they became aware of them, otherwise they could be suppressed. If they are unable to do so, the question could be raised that their behavior was merely negligent.

A "proof of purchase" can eliminate such contention, and substantiate the point in time on which their actions were based on fact rather than any negligent behavior, and it can substantiate the reasons for believing that the law does not require them to file. The facts in the video purchased on such and such a date, are a material demonstration of their knowledge of the facts and understanding at the time. The Fellowship can provide them with a "proof of purchase" in the form of a notarized affidavit which will confirm the date on which they received the information.

If a prospective member purchased a video and has not already received their affidavit, they should call headquarters and the staff will prepare one for them at no charge. If they are in possession of an unauthorized copy, they should seriously consider obtaining a legitimate copy with proof of purchase.

The Just The Facts video series is made part of the extensive education package provided at Tax Freedom 101. If you would like to learn more about the home-study program click here.
