Couple suffers legal setback over Social Security number
April 25, 2004

A Hampton woman who refuses to use her Social Security number lost a court battle. She and her husband say they'll continue to fight.

HAMPTON VA - A Hampton couple's attempt to disassociate themselves from their Social Security numbers because of their religious beliefs was dealt a legal setback Friday when a judge convicted Leslie Carmichael of driving without a valid license.

Neither Carmichael nor her husband have carried a driver's license since 2002, when the Department of Motor Vehicles refused to renew their licenses without Social Security numbers. Although the numbers aren't required to be on the licenses, the DMV told the Carmichaels the numbers were needed for record-keeping purposes.

COMMENTARY:
Should Christians Pay Taxes?
April 24, 2004

I know of no better way to get people's attention than by saying the word "taxes." It seems to work better than calling out "fire" in a crowded room. No one, it seems, likes taxes, unless they're on the receiving end. People complain about the taxes they pay, but rarely disapprove when they are the recipients of tax money.

In addition to income tax, there are sales taxes and other impositions on trade that provide money to the government. Any discussion concerning taxes must attempt to answer questions such as these: What is the purpose of taxation? How much tax should we pay? What is the legitimate amount of tax the government may demand? Does the Bible give us any guidelines for determining legitimate levels of taxation? When should we and shouldn't we pay taxes?

These questions are moral and fortunately, the Bible has plenty to say on the topic.

A Truly Free Church and Ministry Under IRS Attack
April 24, 2004

An ongoing IRS criminal investigation of a unincorporated non 501(c)3 ministry culminated in an IRS raid on April 14th of this year. The raid was conducted because this free church has become too successful in its endeavors. It is becoming evident that the government/IRS will not be satisfied until all religious institutions that freely proclaim the name of Christ and teach His word are placed under their control so they can be regulated, censored, and taxed -- or in this case simply just put out of business. INFORMATION: The SSN and Your New Born

      The following information is provided courtesy of Save-A-Patriot Fellowship member Jeff Oosterman who manages NoSSN.com. Jeff has graciously allowed us to reprint his last two newsletters on the Social Security Administration's directives to maternity ward and department of social services employees under the Enumeration at Birth Program. This is a program that requires arm twisting on part of hospital staff to obtain a parent's written consent via their voluntary signature on the application to enumerate their child with a Social Security number before leaving the hospital.
The NoSSN Newsletter 5/4/2004 - I’ve been doing a little extra research lately into the Enumeration at Birth Program. There is a reason for this; my wife is expecting our first little addition to our family. We found out this past week that it is a boy. Yes, I’m going to have a mini-me.

We have no choice but to have the baby in a hospital. Due to a medical condition, it wouldn’t be good for my wife to go through labor. So, she will have a c-section before there is any danger of going into labor.

I have seen numerous copies of the procedure that is outlined if a parent objects to the assignment of a SSN under the Enumeration at Birth Program. We have a copy on the NoSSN site. There are numerous other copies at various sites on the web. The date I could find on any of them was 1992. I wanted confirmation of this from the source. If you have any doubts about anything, it’s always best to consult the source.

One of the most disturbing things about the 1992 procedure was that it instructed the hospital to get a SSN for the newborn regardless of whether the parents checked yes or no to the question. They were instructed to pretend it was an accident.

I went to the SSA site and started looking around for this procedure. In all my searching on the SSA site, I couldn’t get the laws, regs or manuals through the main site. I did a Google search and found the Program Operations Manual System or POMS on SSA.gov. You can access it here.

If you look up RM 00201.040 entitled “Void Social Security Numbers” you will find a reference to RM 00205.095 which is entitled “When a parent objects to the assignment of an SSN under the EAB process.” The curious thing about this is that the document number is not a link to the page. There are many other references and they are all links to the appropriate page.

I thought to myself, “That’s fine, I’ll just look it up.” That didn’t work. The sequence goes right from RM 00203 to RM 00206. I thought that maybe that part was no longer there. Maybe there was too much public outcry about the procedure.

I wanted to know the story so I submitted a question through the SSA site. I politely asked if that procedure had been taken out or no longer existed. If it did still exist, what was the procedure?

I received a reply. Yes, it did still exist. If I wanted more information, I was to call an 800 number. Yesterday, I called the SSA. I told them I was doing research for an article I was writing. Which is true. They don’t need to know who I’m writing for. I mentioned that I found the reference to the procedure and I would like to know what it was. The woman sounded a little annoyed and mentioned it would take a couple of minutes. She put me on hold and retrieved the document(s) for me. She offered to snail mail them to me. I gave her my business address.

She was actually quite helpful. I mentioned that it was odd that this information was not available on their site. I would think that SSA’s procedures would be publicly available. She agreed and mentioned that she could get the information without a problem. She even gave me the URL she was using: http://policynet.ba.ssa.gov/poms.nsf. Don’t bother trying to go there. It doesn’t work from the Internet. It must be only accessible from within the SSA. Yes, I think it’s absolutely wrong to have any of the SSA's procedures unavailable without asking for them. I didn’t give them much trouble. At the moment, I have an unspoken agreement with the SSA. I don’t bother them, and they don’t bother me. So far it’s working out fine.

I should be receiving my copies of RM 00205.095 in the next couple days. As soon as I get them I will post them at NoSSN.com. Does anybody want to wager what it contains? Will it be any different from the 1992 version? Will they prescribe to actually remove the record without a fight? Do they still instruct the hospital to make a mistake? We shall find out the answer in just a few days.

The NoSSN Newsletter 5/8/2004 - Update on the request for the missing procedure on the SSA's Program Operations Manual. RM 00205.095

It's here! We received it in the mail today. It’s printed straight from the SSA’s own internal Intranet. The URLs are printed clearly at the bottom of each page. Of course we can’t access that.

I know many of you are anxiously awaiting the news. It is not substantially different from the many copies out on the web. The last page notes when the procedure was updated. The last update was 04/15/2002.

There are a few interesting changes. If the parent has used the SSN the request to remove the record will be denied.

There is a new procedure. This is if the parent agrees to keep the SSN but does not want the card. In this case they will destroy the card and they will get an explanation that if they apply for a new card the same number will be assigned.

Another new procedure is that if the parent insists that the SSA delete the information they are to ask if they have used the child’s SSN, for example on a tax return, bank account etc. If it has, the parent(s) will get an explanation that the record cannot be deleted. However, they can still insist that it be deleted. This will result in a report to the CO and a decision will be made there.

There are some format changes. Some of the procedures are in question and answer format. Other than that, there is not much difference. The policy is basically the same.

Of course the best course of action is to not name a newborn until after leaving the hospital. It’s the only way we know of to assure that a newborn is not numbered.
