Dear subscribers, many of you who read our newsletter receive it via email by request, while others of you may read it posted on the net in various places. We appreciate the fact that you share this newsletter with others, and when you do share it with others, be it family, friends or associates, you are planting seeds in their minds. Seeds that may one day germinate and turn them into magnificent mighty oaks of liberty-conscious citizens. These same people may one day end up protecting your Constitutionally granted rights. You never know whose life you may change when you share this newsletter with others. We thank your devotion and for your support in seeing that this newsletter gets to others.

This brings us to another point. Yahoo Groups! (formerly eGroups) who we use to distribute this newsletter is considering charging for its service, a service which has been "free" up until now for those moderators using Yahoo. Apparently the ads Yahoo appends to every message which leaves its server is not making up for the cost required to distribute the emails, or they just need to bring in more revenue for operations. We understand. There really is no such thing as the concept of "free" in consumer terms. We couldn't do what we do for free without eventually, going-out-of-business. "Free" in today's terms means either prepaid for by someone else, or made part of future cost. It was inevitable that Yahoo would begin charging moderators for its "Group List" service. Just exactly when this will happen is anyone's guess, but our guess is very soon - and that means an added cost to us here at Tax Freedom 101. What does that mean for you dear reader? It means that if you want to continue to be provided with the updates, news, and information contained in this weekly report we will need your financial support.

We have decided to ask for your support by voluntary contributions. As you may have noticed, we have included a donate button under the "Support this work!" just beneath the header of the newsletter. Before you say that this voluntary contribution idea is socialistic in nature, let us please make a differentiation. For instance, unlike Social Security which is totally socialistic - where your "voluntary" contribution is made by force or coercion, that is not the case here. We are not holding a gun to your head or threatening to take it from your bank account. We should also make mention that Tax Freedom 101 is an unincorporated association, and has not sought certain "privileges" from government to exist, unlike other supposedly "nonprofit" groups and organizations which are under the control of the IRS. Therefore your voluntary contribution or donation would obviously NOT be tax deductible. So it is good honest gifts from the heart that we seek, not gifts that will ultimately be indirectly returned back to government.

We run a tight-ship here, and assure you that any donations that Tax Freedom 101 receives will be put to good use. We feel the work we do is too important not to ask for your help. We currently have two accounts with Yahoo now. One we use for time sensitive information TAXFREEDOM101, which also distributes the Constitutional Quiz Question of the Week, among many other things, and this weekly e-newsletter, The Tax Freedom 101 Report. If we receive enough support we should be able to keep both of these lists humming with the information you desire.

While Yahoo is not charging yet we are certain they will soon, that is why we are getting a jump on the inevitable cost facing us. - Exchanging Privacy for "Security"?

Whose behind selling out your privacy this time? It's the banksters. Greedy bankers are pandering at the feet of Tom Ridge who heads up the newly created and unconstitutional Homeland Security Agency. What they're really attempting to exchange is your privacy for their profit. Using terrorism as a backdrop for the proposal to circumvent state privacy protection laws, the banks want certain restrictions in current regulations loosened so they can sell information to the private business sector.

By the way, you never really had any real privacy to begin with when you opened your bank account. - Voluntary Tax, and Now... Voluntary Tax Contributions

Honestly, the only reason we are running this news item is so we can share a related information article called, "What About State Income Taxes?". The news item below titled, "Virginia happy to oblige generosity" is just so idiotic it defies belief, but what do you expect from representatives in an election year but idiotic proposals, such as a bill to promote voluntary tax contributions. According to other states which make use of similar plans no one "contributes" voluntarily. However if people believe the income tax is mandatory of course they will pay. But is it really mandatory? We will let you decide.

Excerpt from Virginia happy to oblige generosity article as run in The Washington Times: "It's the greatest thing since sliced bread," said Delegate M. Kirkland Cox, the sponsor of a bill that would expand — with better promotion and more incentives — an existing program that allows Virginians to make voluntary tax contributions.

Ummm if we may... Actually Mr. Cox, state income taxes for citizens living and working in the United States are already voluntary. If you do not understand how this can be please read "What About State Income Taxes?" below.

In order to truly understand our government, it is essential that we understand taxation. Many people do not know the difference between "taxing" and "takings". Many people also do not know what the legitimate function of government is. What many people do know however, is that our government has gone beyond its legitimate bounds, to the detriment of We the People. There are many symptoms of this that are undeniable. For instance, many people are aware that we are the most hated nation on the planet. Could this be the result of a federal Government acting outside its Constitutional boundaries, meddling in the affairs of other countries and fighting other peoples' wars? Closer to home, many are also aware that our government schools are poisoning the minds of young people. Perhaps you've heard about Elliott Chambers, a 16-yearold student at Woodbury High School near St. Paul, who wore a sweatshirt carrying the trademarked logo "Straight Pride" on the front, and figures of a man and woman holding hands on the back. The principle said he couldn't wear the shirt anymore because it was "offensive." And when his mother expressed concern that moral lessons being taught at home were being undermined in school, the principal called her a "homophobe." So yes, there are many people who can see that our government has exceeded its legitimate scope and function in many ways. And of these people, there are those who wish to do something to bring the government back under the bounds of the law that created it. They strive to do what they can individually; and they in fact can help in this struggle collectively as well. This is where Save-A-Patriot Fellowship comes in. This is what I wish to discuss today.

To begin, we need to understand what tire purpose of government is. Frederick Bastiat explained it quite eloquently in The Law, wherein he stated:

"If every person has the right to defend -- even by force -- his person, his liberty, and his property, then it follows that a group of men have the right to organize and support a common force to protect these rights constantly. Thus the principle of collective right -- its reason for existing, its lawfulness -- is based on individual right. And the common force that protects this collective right cannot logically have any other purpose or any other mission than that for which it acts as a substitute. If this is true, then nothing can be more evident than this: The law is the organization of the natural right of lawful defense. It is the substitution of a common force for individual forces. And this common force is to do only what the individual forces have a natural and lawful right to do: to protect persons, liberties, and properties, to maintain the right of each, and to cause justice to reign over us all."


To this end, the Founders declared our independence stating that all men
"...are endowed by their Creator with certain unalienable Rights, that among these are Life, Liberty and the pursuit of Happiness." (The founders were going to originally use the words "Life, Liberty, and Property," but instead decided on "pursuit of Happiness" thinking that it was more all-inclusive.)

It is not disputable that the Founders and Framers believed that one of the most important goals of the Constitution was to guarantee property rights. This protection, defined broadly, was seen as the critical justification for government.

It is clear that the Sweeping Section (Art. I, Sec. 8) of the Constitution grants Congress the power to lay taxes. Nevertheless, granting the government the power to tax does not release it from its obligations under the Takings Clause of the Fifth Amendment to spend such revenues only on those purposes of government which are (1) for public use; and (2) provide compensation to all whose property (e.g., incomes) are taken. Money is to be seized only to support the commonly understood function of Government the protection of individual rights from intrusion by foreigners, the state or other members of society. This obligation forms the core of the 5th Amendment. Accordingly, socialism (wealth redistribution) is forever banned.

Most of our members are fully aware the only legitimate jurisdictions of the federal government within the states of the Union are interstate commerce, postal roads, counterfeiting (which is virtually nonexistent, since legitimate currency is virtually extinct) and investigating espionage matters. If the federal government was brought back under the Constitution, the cost of running the government would be a mere trifle of what it currently is. Additionally, other jurisdictions, such as those legitimately of the state, county, family, church [e.g., §501(c)(3)] and individual (citizen) would be able to regain their sovereignty, which is essential to liberty.

When our Constitutional government functions as the Founders intended, taxing incomes is totally unnecessary. Indeed, the concept of ownership of property being fundamental to a People, is very ancient: it comes right out of the Bible. Most of us are familiar with what Christ had to say in this regard:
"What thinkest thou, Simon? Of whom do the kings of the earth take custom or tribute? Of their own children, or of strangers? Peter saith unto him, Of strangers. Jesus saith unto him, Then are the children free." (Mat. 17: 25-26)

The Framers must have been quite familiar with this verse and its implications. The Constitution authorized only excises, impost and duties, and, as necessary, a direct tax apportioned among the states, and nothing else. This means that since the government was only authorized to do that which was specified in the constitution, and there were no implied powers, taxing the incomes of the citizens of the several states was not legitimately possible. Furthermore, the
"...Sixteenth Amendment conferred no new power of taxation but simply prohibited the previous complete and plenary power of income taxation possessed by Congress from the beginning from being taken out of the category of indirect taxation to which it inherently belonged." Stanton v. Baltic Mining Co., 240 U.S. 103, 36 S.Ct. 278 (1916) In other words, Stanton, the Court affirmed that the 16th Amendment did not repeal Article I, Sec. 9, Cl. 4, which prohibits direct taxation by the government, and acknowledged that it was a direct tax.

Now that we have (1) defined the legitimate function of government; (2) that where liberty reigns, people have an inalienable right to own property; (3) distinguished the difference between "taxation" and "taking"; and established that the Takings Clause of the Constitution bans taxing the income of citizens in keeping with the taxing provisions (even with the 16th Amendment, as per the USSC): we may now intelligently decide upon a prudent course of action, individually as well as collectively, to get our Nation back under the very law that created it. After all,
"All that is necessary for the triumph of evil is that good men do nothing." (Edmund Burke) And that begins with education of ourselves and our fellow Citizens as to liberty, history and truth.

Two centuries ago, Thomas Jefferson is supposed to have said,
"Eternal vigilance is the price of liberty." He didn't just mean vigilance against foreign attack. The greatest threat to Liberty, even in today's precarious times, comes from no foreign foe. It comes from demagogues in government offices who, over several generations, let the power and the resources that are the basis of liberty be wrested from the grassroots America and put into the hands of a remote central authority. Today, we still have the opportunity to turn that centralization of power around. In fact, we have an obligation to do what we can to get the government back tinder the law, since "Resistance to Tyranny is Service to God."

You can see from the lead article of this newsletter that we are making substantial progress.

If you would like to read this lead article please refer to your May 2001 Liberty Tree issue.] In the meantime, however, we need to press the advantage. Now, more than ever, people need to organize and support the effort. It is the only way it can be done. We have to organize, and we have to support one another. We need to act collectively, in the way of offense and defense, and Save-A-Patriot Fellowship is the best, if not the only means of achieving this that exists in America today. Save-A-Patriot has probably had the largest impact upon IRS tyranny of any grassroots group to date. Our name appears in the Internal Revenue Manual at least three times, so they must really appreciate us. Save-A-Patriot is designed not to fight just some facet or social ill, but to overcome this march to world government and the destruction of individual liberties. While Save-A-Patriot is not the only patriotic group in the country (thank God), it is the only one that has insurance-like protection against losses of property or the unlawfully incarcerated. We educate the people as to the law, minus the patriot mythology which, sadly, abounds in this movement. We're also a full service fellowship, with caseworker and paralegal departments that even lawyers utilize. Due to many years of hard effort, we are everything that a fellowship ought to be. It didn't just happen overnight.

To those who say you can't fight city hall, I insist they are wrong. Our politicians are not impervious to the pressure we the people are exerting. We need to keep chipping away. The only way the government can be forced to abide by the law that created it, is to educate the public so that they can elect statesmen instead of crooked demagogues who constantly hold power and plunder the people. We have seen that Congress was forced to make these changes because of the demands of the public. And remember, Save-A-Patriot is not as a lone voice speaking in the wilderness we are thousands of voices, and our collective voice (Save-A-Patriot and Liberty Works Radio Network) is heard around the world. The dishonest politicians are scared to death of that.

We the People need Save-A-Patriot more than ever. Save-A-Patriot, while a formidable force for lawful reform, needs to become larger, and this means we need new members to join. If Save-A-Patriot becomes large enough, it will become a voice against tyranny that the demagogues in public office will be unable to ignore. Imagine if we had 100,000 members! That would be end-game for the current socialist and globalist regime. Imagine loosing a $100,000 home to an unlawful IRS seizure, and each of 100,000 members send you $10; you'd be a millionaire! Instead of feeling very low about it, you and your family loosing the home you worked hard for all your lives, you'd feel pretty good about the whole thing! Robbing the power of the IRS to unlawfully ruin our membership financially would render them impotent. Word would get out, and membership would skyrocket from there.
End-game!

We are making more progress in this respect than most members might know. Most of our recent members putting in for assessments received substantially more than they lost. We are the only fellowship of its kind that can make that claim.

Encourage friends and family to join Save-A-Patriot. Even if you never need to make an assessment, you will sleep better at night knowing that you are doing something useful to safeguard the legacy of liberty of our children.

Remember…
"We must all hang together; or , assuredly, we shall all hang separately."
