Driver’s Licenses –
I have had a couple of inquiries lately concerning Driver’s Licenses. I know that in the wake of the Patriot Act and the looming Real ID Act, it may be virtually impossible to obtain a valid driver’s license without a SSN. Naturally, we here at NoSSN feel that this is ridiculous. If you were born here there is no requirement to have or use a SSN. That would mean that only aliens should be able to get driver’s licenses. Yes, I agree, that is preposterous. Not only that but if the purpose of the law is to establish a person’s identity, how does being able to spout off nine digits confirm anyone is who they say they are?

I know that people have had success in the past obtaining a driver’s license by getting a letter from the SSA stating the person never had an SSN. This satisfied the state. I have not heard of any such success stories recently. If anyone has had any success recently (post patriot act) on obtaining a driver’s license sans SSN please let me know. I would like to pass this information on.

Social Security at Wikipedia –
I’ve been having some fun at Wikipedia. I created an account and I’m working on adding a little more truth to the section on Social Security. I’m doing this very slowly. Adding a line, editing a line etc. just making things a bit clearer. I never do so much that it will raise a flag. Give it a little while and pretty soon, we’ll have the entire truth there.

For example; last week I edited the line that read:

There is no legal requirement for individuals to join the Social Security program.

Now it reads:
There is no legal requirement for individuals to join or participate in the Social Security program.

See how just adding a prepositional phrase will add new meaning to the sentence. There is always truth, just not the whole truth.

I'm going to continue and see how far I can get.

DOJ files a permanent injunction against Save A Patriot –

I’ve been out of the loop with Save A Patriot for about a year now. I haven’t spoken with anyone there. I read the article and the injunction.

I actually found it hard to believe that the DOJ would target SAP. The DOJ has raided the SAP headquarters twice and gave them a clean bill of health. That was nearly ten years ago. They have been operating the same since then. What was perfectly fine then should certainly be OK now. Besides, targeting somebody multiple times without making any charges stick could be construed as harassment.

The injunction states that they were in violation of 6700 and 6701. These are the sections that deal with abusive tax shelters. I can tell you from first hand experience that SAP is not an abusive tax shelter.

It is also crystal clear to me that the DOJ didn’t even bother to look over the materials. They stipulated all over the place that SAP was using the 861-Sources argument. SAP always avoided that argument since it had been thrown out of court so often. It may have been true but the courts have the precedents and the law means what they say it means.

I also noticed something interesting. In all the documents the DOJ seemed to rely awfully heavily on caselaw. They would never argue what the law says. It always what the courts say it says.

Also from first hand experience I know that SAP never sold any plan or arrangement that was said to secure any tax benefit, especially any that was known to be false. They also never sold any tapes, videos, books or manuals containing any false commercial speech.

Yes, they did help out members by writing response letters, and pleadings to the IRS. All this was to ensure the members due process (a right guaranteed by the Constituion). They are now barred from this activity.

The injunction states that they advised people they didn’t have to pay federal taxes. This is false. One of the first things SAP would tell you was, “We don’t give advice. We tell you what the law says.” Of course what you do with that information is your responsibility.

I am also puzzled by the injunction stating that the Victory Express and the Patriot Defense fund had to stop. The memorandum stated that these entice people to break the law. I would like to start an Audit Insurance business. I’ll pay you if you get audited or have any trouble with the IRS. Would that be illegal as well?

What I think happened is that it has now been long enough and enough case-law put in the books that just about anything you do now can be covered by 6700 and 6701. Since one guy was found guilty of doing one thing, now it’s not a stretch that this other guy can be covered too. If he’s guilty then so is number three. Next thing you, no one will halp anyone with any taxes.

It used to be it was ok to avoid taxes but it was illegal to evade taxes. Now they have coined the term abusive tax avoidance. That’s illegal now. Then there is my favorite word avoision which is a cross between avoidance and evasion. Now all of these are illegal. The laws regarding these things have not changed. So what happened? The courts have gradually manipulated there decisions. Now you are guilty if you tell someone what the law says.

What’s next? Thought Crime.

42 USC Sec. 408 provides that: Whoever ... (8) discloses, uses, or compels the disclosure of the social security number of any person in violation of the laws of the United States; shall be guilty of a felony and upon conviction thereof shall be fined under title 18 or imprisoned for not more than five years, or both.

The Privacy Act makes it unlawful to require a SSN unless it is specifically required by law.
