I’m sorry I didn’t send the Newsletter last week. I was away. I was on a trip to a conference in Nashville, Tennessee. I had a great time and made it through airport security without a problem. I had to take off my shoes and they confiscated a lighter I had in my camera bag that I had forgotten was there.

I received an e-mail response to one of my previous Newsletters. Here is the response and my answer. No names are used here.

Like you I have had connections before I learned the scope of the situation. The only thing that is still connected to that infernal number is my driver's license. There isn't a whole lot that can be done for me at this point.

For those of us that have used a number in the past, there is little that can be done for certain items such as a driver's license.

For our children, we can see to it that they never receive a number. A driver's license can be issued to a person that has never had a number if you ask the SSA for a statement that says that they have no record of that person.

With a letter such as that, one can obtain a driver's license, passport and other government documents. I have had many reports of success with this.

Unfortunately, if you have used a number in the past, and you would like a passport with no number, it's a $500 fine. So it will cost $570 for a passport. That's the way it is.

One of the things that bother me is that the law which requires the SSN on a passport application is not found under immigration it’s not found in Title 42, the Social Security Act, it's found in Title 26, the Internal Revenue Code. Seems to me like the IRS has their talons implanted everywhere.

One of the most frequently used tools that patriots use to "plug in" to the system is the creation of a legal entity. A legal entity is something such as a Corporation, LLC, LLP, LP and other types of entities. These entities have almost the same capabilities as a "person". As a matter of fact, many laws define a "person" as a corporation. Once you create an entity, you can then apply for a EIN for the entity and use that to do such things as open a bank account.

Granted, you will need a friend or a relative to do a few things for you. One of these things is the application for an EIN. The application requires a signer with an SSN. This person can rest easy. The application creates no liability for the person who signs it. The person just needs to be somebody involved with the entity such as the treasurer of the corporation. You can then have the treasurer open a bank account for the corporation.

Many banks will allow extra signers on the account without an SSN. If your bank of choice does not, then have a rubber stamp made for your treasurer. Once this is complete, the treasurer may resign. Make sure all of this is documented. If there are any issues, you don't want to raise questions.

There are questions that need to be answered before starting this procedure. First, what type of entity will serve you best and where to do it?

There are several types of entities to consider. There are C Corp.’s S Corp.’s, LLC’s, LLP’s, LP’s and a myriad of different types of trusts that you can utilize to accomplish what it is you want to do. You can also create several entities and structure them for different purposes.

Then you need to decide where you wish to form your entities. Popular places to form business entities include, but are not limited to: Delaware, Wyoming, New Mexico and Nevada. Nevada is the only state in the union that does not an information sharing agreement with the IRS. Yes, I am now grateful for gambling and prostitution.

It is also a good idea to choose the person who you will use to apply for your EIN and open your bank account wisely. If you have someone with whom you would like to do business with and who can also benefit from the entity that is a good choice. Certainly you should choose someone whom you trust. I don't want to sound morbid, but there is another option that is very good. If you have a friend or relative or relative of a friend who is elderly and/or in poor health, they could be a good choice. Granted, you want to approach the situation delicately. You don't want to ask them and tell them you want them to do this for you because we expect them to depart this earth soon. The truth is, there is very little risk for them.

Whatever you do I would suggest you enlist the help of an entity specialist when taking this route. They can certainly offer you suggestions to accomplish what you need to do. They can also help you make sure that things are done right. I can send you a list of a couple of companies that can help you out with this. Just send me an e-mail.

One more thing you can do with an entity that you can’t do with a real live person is kill it. Anytime you want, you can dissolve the entity and create a new one. Just think of the possibilities there. If anything happens and you have no need for it any longer, dissolve it, cash out, create a new one.

If you are working for another company and you don’t want withholding, you can use your enitity to rent yourself to the company you work for. You just need to send them an invoice every week, two weeks or month for the time worked, they cut you a check. They are covered, the money goes into the entity’s bank account, you decide how to spend it. They don’t even have to send out a 1099!

One other recent option I just heard about is ALFII - Americans for Lawful Financial Independence and Information. This company offers “bank-like” services. You can deposit money from a variety of sources and what you are inreality to doing is prepaying for Money Orders. No need for a checking account!

Personally I haven’t used them yet, but I plan to very soon. if anyone has any experience with ALFII, please let me know. I haven't heard anything about them, good or bad.

I would like to thank everybody for their responses to the last NewsLetter. I thought it would be a good idea to keep everyone updated.

ALFII

I have gotten responses from many people who are using ALFII. Everything I have gotten has been extremely positive. I need to get one of these accounts for myself. NoSSN required. They offer “Bank-like” services. You deposit money into the account from a variety of sources. You can then print DMOs (Digital Money Orders) right from your PC.

You can fund the account from a variety of sources. You can send them checks, e-gold, e-bullion and Liberty Dollars. You can even get Liberty Dollars at a discount from ALFII. One member told me they always send checks to ALFII and they deposit them into the account with no problem. These are checks not made out to ALFII but made out to the person on the account.

Members also get a VISA debit card which they can fund from their ALFII account or from any of the sources they use. With these they can make purchases and get cash at an ATM. Sounds good to me!

They also have an anonymous remailing service.

Driver’s Licenses

There are many people that I know that are driving without a driver’s license. It was pointed out to me that because of this, they are making sure that they drive very carefully. They take no chances when out on the road. They are extremely safe drivers.

Generally these people will have a friend or relative own the vehicle and insure it. I know of one person that has a Trust based in New Hampshire. He had the Trust lease a vehicle for him. This is very smart. New Hampshire has no sales tax or income tax. leasing also means that he doesn't own the vehicle. Remember, what you don't own can never be taken away from you.

There are many options and you can get very creative. Don’t be afraid to spend a few dollars creating one or more entities. They can come in very handy and provide multiple layers of protection. This protection includes privacy as well as legal (judgement proofing) protection.

Dare I ask? If anyone wishes to share with me how they have their entities structured and how they are using them, I will share them with this list. Of course, your privacy will be maintained. We won’t use any names.

You can also use your expired driver’s license as ID. When using an expired license as an ID card, most people don’t bother looking at the expiration date.

Terry Stops

I had to look up and find out what a “terry stop” is. Here is what I found:

Can The Police Stop And Question People Who Are Not Under Arrest?
Yes. The police can stop a person, and ask questions, without "arresting" the person. Upon seeing suspicious activity, the police may perform what is called a "Terry Stop," and may temporarily detain people to request that they identify themselves and to question them about the suspicious activity. The scope of a "Terry Stop" is limited to investigation of the specific suspicious activity, and if the police detain people to question them about additional matters, the stop can turn into an "arrest." For their own safety, the police can perform a "weapons frisk" on the outside of a person's clothes (sometimes called "patting down the suspect") during a "Terry Stop." During this frisk, if they feel something that may be a weapon, they may remove it from the suspect for further examination. However, they are not entitled to remove items from person's pockets that do not appear to be weapons, even if they believe that the items are contraband.

Passports

I had one person respond and tell me that they applied for a passport without an SSN. They did not get fined. This is not to say that you won’t get fined if you apply for a passport without an SSN although it has happened.

The law states that if you do not supply an SSN on your passport application, you “may be” subject to a fine of $500. So, if you do decide to apply for a passport sans SSN, don’t be surprised if you get fined. Then again, maybe not….

Yours truly needs to get a passport soon. I think I will wait until I have the $500 available, just in case.
