READER: "Your little funtime joke has caused alot of dismay to people who believed what you said! It was a despicable act on your part to get the hopes up for people who, like you, are working to get the IRS disbanded. You really need to take a good look at yourself and apologize to yourself for misleading so many good folks!!!"
AUTHOR: Who ever said we are trying to get the IRS disbanded? We think they're the cat's meow - wink. By the way, thanks, I took your advice and had a long hard stare in the mirror - almost left the office with my fly down.

READER: There is no literal white flag at the IRS building, right? It is difficult in articles like these whether such statements are metaphorical or literal. There is a fine line between IRS employees applying for other bureaucracies and the IRS raising a white flag and "surrendering". After all, the IRS is a paid organization, not a militia.
AUTHOR: Actually they have a few different kinds of flags to signal in the flying monkeys during inclement weather.

* Gone in 60 Minutes
Tonight, Tuesday April 5th, on CBS' 60 Minutes II there will be interviewed an employer who no longer withholds taxes from his employees. There are many employers who have stopped withholding at the workers request. There will also be an ex-IRS agent from the Criminal Investigation Division interviewed who realized there was no law requiring a citizen to have withholding from their pay. There are more IRS agents defecting now. Also included in the piece is an organization which is favorable to the government's position on taxation. This well funded 501(c)3 non-profit, tax exempt, and regulated "educational foundation" has been a leading force in keeping "conservatives" blindfolded to the truth about the real monetary issues and our system of taxation. Then of course there will be the big cheese himself the IRS Commissioner Charles Rossotti.

The fellowship, its independent representatives, and staff NEVER do taped or non-live interviews with the media. We only will participate in live unedited broadcasts. We know how the controlled media is used to sway its viewers to the government line. We doubt tonight will be no different. We are concerned that the movement may take another step backward as the people behind 60 Minutes are infamous for twisting the facts through editing techniques. If you have not watched the expose' "60 Minutes Deception" produced by the investigative journalist Christopher Ruddy, and do not have all the facts about lawful taxation then you could be a victim of misinformation after watching 60 Minutes II.


* Another Dog and Pony Show
The Senate Finance Committee has scheduled a hearing for 10 am Thursday morning to review the impact of the full page USA Today public service announcements from the We The People Foundation. The various public service announcements have been running of late on Friday's explaining the hot topics in the tax education realm, such as: the ratification of the 16th amendment, IRS agents who have defected from the service because they say there is actually no law requiring a citizen to file a return, and employers who have stopped withholding in the workplace.

IRS Commissioner Charles Rossotti is expected to testify about the impact of the public service announcements encouraging citizens to investigate the law, IRS, and the Federal Reserve. The establishment must be getting worried. Will those in power stage another dog-n-pony show for the public? There is talk of the Senate Finance Committee hearings being televised on C-Span, keep an eye out for the broadcast.

This from Bob Schulz, "The Senate Finance Committee may not want us to testify because they want to control what gets said on the record. I believe as many of us as can do so should plan on attending the hearing. If we are not allowed to testify, we will hold a press conference outside the hearing room. I believe all the major media outlets will cover our press conference. We will detail the efforts by Bill Benson, Joe Banister, Dave Bosset, Dick Simkanin, Al Thompson, the We The People Foundation For Constitutional Education, and others to get the Senate (and the House, and the White House, and the IRS) to discuss and debate the issues, and to address the allegations of fraud and the illegal operations of the income tax system. Our message will be: 'There is strong evidence that the IRS is disobeying the laws and forcing citizens to pay taxes they are not, by law, required to pay. Both the IRS and Congress refuse to answer the questions and allegations raised by numerous tax researchers, based on credible evidence. We want the IRS to obey the tax laws. Researchers allege the IRS is operating the biggest hoax ever perpetrated on any people by any government. The Senate is questioning the right man when it comes to scams and fraud'."

Encourage those representatives from your state who sit on the Finance Committee to allow those being investigated to testify. You will have to call your representatives' offices directly since they ignore emailthese days.

* Hear Ye, Hear Ye...
If you are not familiar with World Net Daily they have been finally reporting the news about the Constitutional Revival Movement. Although they begin title of the following article, "Tax revolt!" we would like our readers to know that we are not about revolution. We are about restoration. The law as written with respect to the tax law is fine, it is just being grossly misapplied for the benefit of those who wish to destroy this nation. Please read the article with this in mind -- "We do not fear our government, we fear citizens who do not know what their government is doing."

Tax revolt! - How Americans are challenging the IRS and the 16th Amendment

When America was born -- amid the revolutionary fires of war, principle and faith -- the new nation represented the noblest system of government in history. Rather than being subject to "the divine right" of kings and tyrants, as was most everywhere else on earth, in America the individual citizen was meant to be sovereign, and the government existed only to serve his highest interests.


While fear and dread were the heartbeat of virtually every other society on earth -- from which "the huddled masses yearning to breathe free" emigrated to these shores -- boundless, unfettered opportunity to succeed and to fail, and above all else, freedom from government tyranny constituted the real prize for those fortunate enough to call themselves "Americans."

Not any more.

Today, most Americans live in some degree of fear of their government, which has grown to gargantuan proportions unimaginable to the country's founders. Indeed, the images of the Waco conflagration, of Ruby Ridge, of the pre-dawn commando raid for Elian Gonzalez, and other such national traumas are seared into Americans' minds and hearts -- intentionally -- for the purpose of cultivating compliance through fear.

And of all the federal agencies -- FBI, ATF, Immigration -- that have come to inspire such fear, none even comes close to eliciting more raw, primordial terror in more people than does the Internal Revenue Service.

But does this fear exist because Americans as a whole are unwilling to pay their fair share of taxes? Or because Americans are not patriotic and fair-minded? There's not a shred of evidence supporting this idea, nor does anyone even contend that it is the case.

And yet, it is the particular kind of taxation that has been foisted on Americans -- the income tax -- that ushered into Americans' lives the intimidation, intrusion, humiliation, involuntary servitude (employers being forced to collect taxes through withholding) and just plain fear, in the shadow of which honest, hard-working, law-abiding Americans suffer year after year.

* Indictments, but not for "Several" Years
This next article is chock full of interesting news. Again the IRS' media mouthpiece and fear propagander, David Cay Johnston reports on some of the more publicly recognized business owners who have stopped tax withholding in the workplace. We find this quote most interesting... "Several senior I.R.S. officials have said in recent weeks that they expect that business owners who boasted about not withholding taxes would be indicted, but not for several years." Company Faces I.R.S. Suit for Not Withholding Taxes

After months of ignoring several dozen business owners who boasted that they no longer withhold taxes from paychecks, the Internal Revenue Service has taken civil action against one of these companies.

It has also sent letters to workers at these companies telling them that they must pay taxes, whether their bosses withhold them or not.

The Justice Department filed a civil suit on Monday in United States District Court in Tampa, Fla., against the Bosset Marketing Partners of Clearwater, Fla., to recover what it contends is an "erroneous refund" of $21,916 in income, Social Security and Medicare taxes that had been withheld from employee paychecks in 1996.

David Bosset, owner of the multilevel marketing company, said yesterday that he had not been served with the suit. "I find the whole thing humorous," he said.

Mr. Bosset withheld taxes through the last quarter of 1996. In June 1999, Mr. Bosset applied for a refund by filing an amended return which, according to the lawsuit, stated that his employees were not subject to income tax and that the amounts paid to its employees were not 'wages' within the meaning of the Internal Revenue Code."

Mr. Bosset is a leading proponent of the theory that Section 861 of the Internal Revenue Code exempts American-owned companies from income taxes.

Charles O. Rossotti, the tax commissioner, has called the theory nonsense.

Last night, the I.R.S. released letters it is sending to workers at the companies that have stopped withholding. "You are required to file a return and pay taxes on your wages," the letters state. "Any information provided to you that claims otherwise is incorrect."

Similar letters are being sent to the employers, along with a warning that the owners risk prosecution.

One of the companies, the Kristi Tool Company in Magnolia, Mass., has not withheld taxes for more than two decades and its owner, Dick Celata, said he had never been contacted by the I.R.S.

Business owners who fail to turn over withholding taxes are subject to penalties that double the taxes due plus interest, as well as criminal prosecution.

Until now proponents of the so-called 861 position have cited Mr. Rossotti's inaction as proof that the tax laws are a gigantic deception.

These proponents, part of a larger movement which calls itself the tax honesty movement, say that a steady stream of businesses have stopped withholding taxes since the movement was the subject of a front-page article in The New York Times on Nov. 19. Among the companies that have declared this year that they do not withhold taxes are Batavia Enclosures in Batavia, N.Y.; Certon Inc. in South Houston, Tex.; and Ikon Roofing in Chowchilla, Calif.

Several senior I.R.S. officials have said in recent weeks that they expect that business owners who boasted about not withholding taxes would be indicted, but not for several years.

A leader of the movement, Robert L. Schulz, president of the We the People Foundation for Constitutional Education in Queensbury, N.Y., said he welcomed the civil action against Mr. Bosset's company. "This is good," he said. "Both sides will get to argue the issues. Time will tell."

* Beware All So-Called "Tax Reform" Proposals!
If anyone promotes any of the following so-called "tax reforms", ask them the following questions:

Flat Tax

Congress, and only Congress sets the rates and schedules. Congress could, if it wished, adopt a "flat rate" tax schedule tomorrow morning, with or without your consent. Question: If a "flat tax" is so great, why do they need to promote it to the public to get it's acceptance? Answer: This proposal is merely a diversion to take the public's attention away from the real facts about the income tax (which Congress and the IRS would rather you not know).

National Sales Tax (NST) or Value Added Tax (VAT), etc.

Ask the proponent to quote what section of the Constitution gives Congress the power to impose any such tax? Answer: Congress has no such Constitutional power. Ask the proponent of this measure if they are then proposing amending the Constitution to give such power to Congress? Answer: Any such attempted amendment would be contrary to the basic document and therefore unconstitutional.

Again, another diversion to keep the public ignorant of what the tax laws really are and how they are being criminally and willfully misapplied by the IRS.


Abolish the Tax Code!

Ask the proponents of this measure exactly what part of the tax code they are proposing to abolish? All of the subtitles under Title 26 United States Code (Internal Revenue Code)? Or only some? Then which ones? Subtitles A, B, C, D, E are those of the 11 subtitles which deal with taxes, the rest do not. Subtitle A deals with income taxes, B with estate taxes, C with employment taxes (often referred to as FICA or social security taxes), D with misc. excise taxes such as manufacturer's excise taxes, wagering taxes, import taxes, etc., and E with excise taxes on alcohol, tobacco, and firearms. So, which of these subtitles do they wish to abolish? Abolish Subtitle A, Income Tax? This subtitle imposes income taxes only on foreigners who are deriving income from investments or business activity within the United States, not on the income of U.S. Citizens or residents of any of the 50 union states. Abolish Subtitle C? Subtitle C covers the citizen's or resident's voluntary participation to build up credits toward vesting in wealth redistribution programs such as social security benefits, and only if they wish to participate since there is no requirement under law to have or use a SSN. So exactly which subtitle does Congress wish to abolish? And to what end? Again, this is but an unreasoned reaction by persons with no real knowledge of our tax laws.

Abolish the IRS?

Congress has the sole power to lay and collect indirect excise taxes such as income tax. The IRS is simply the collection arm of Congress. If the IRS is abolished, Congress would then have to establish some other agency to collect the duties, imposts, excise taxes, foreigner's income taxes, and voluntary social security taxes. So what would be gained?

The REAL Reform Needed!

The tax laws, as they are written and "on the books" right now, are correct, proper, and 100% constitutional! There is no reason to repeal, replace, modify, or otherwise disturb those laws. What is wrong is the IRS' improper, unlawful, even criminal mis-administration of those laws. And Congress lets them get away with it! The wild stories you hear about IRS criminal abuses are not due to anything amiss in the law, but simply due to an agency run amok. Congress, and only Congress, has the unquestioned power to see that the IRS is restrained within the law. Confront your Congressman - Ask him when he is going to see that the IRS starts acting lawfully in its collection actions? In its fraudulent liens and levies? In its illegal property seizures? It is time we Citizens demand our elected public servants, our congressmen and senators, initiate the real needed tax reform: compel IRS personnel to operate totally within the constraints of the written law or face punishment, fines and discharge.
