Irwin Schiff was recently sentenced to over 13 years in prison.

I give Irwin a lot of credit. He always stood firm and did not waiver in his beliefs.

If you take a look at the court filings and what went on in court during Irwin's trial, you will see very clearly that he was, without a doubt, railroaded. He was not allowed at any point to bring the law into evidence. That makes a lot of sense. If this is indeed a court of law, why can't the law be presented as evidence? Especially considering the fact that Irwin bases his beliefs on what is in the written law. Naturally the judge waived his magic "frivolous wand" with furious abandon. In this court of law, the law was thrown out the window. The law says what the judge says it says.

I have several maxims which I live by. For those that don't know what a maxim is, here is the
definition:

max•im: A succinct formulation of a fundamental principle, general truth, or rule of conduct.

I have many maxims that I can share with you. These are the ones which Irwin didn't follow and my explanation.

1) Stay out of the public eye.
Granted I want to share information about all of this with everybody but I'm not about to erect a lighted sign saying "I can teach you how to pay no income tax!". That will amount to a big red flag.
The IRS gets mad enough at people that don't pay what they say they owe. They get even more upset when you advertise that you can teach others. It's just a bad plan.

2) Never use a SSN for any reason.
There is no law that requires anyone to use a SSN. There is nothing wrong at all with refusing to use a SSN. That is what the NoSSN site is all about. Just because the IRS will not cash your tax check without it is not my fault or yours.

The SSN is the government lynchpin. Without it, they have no means to track you. They can't prove you had income. They can guesstimate but that is it, only a guess. They can't "credit your earnings" they can't post a receipt. They can do nothing. It's like you don't exist. Without a SSN, you don't appear on the radar screen.

3) Don't do business with government agencies.
The SSA and I have an unspoken agreement. I don't bother them, they don't bother me. One of the things that Irwin did that I did not know about was he was applying for and receiving benefits from Social Security. I don't know what he was thinking on this one. For one thing he was running Freedom Books and making money from that and his seminars. He obviously did not need the money. Second, the government certainly is not going to appreciate someone who tells people not to pay into the system and then turns around and not only accepts money but asks for a hand out.

It's just not a smart thing to do. Don't ask for money at the same time your telling others not to pay into the system.

You can't suck the nipple without feeding the pig.

4) Don't file.
For one thing willful failure to file is a misdemeanor. Filing a false return is a felony. Irwin advocated filing a "zero return". According to the 1040 instructions if you had insufficient income, you don't have to file. I do understand that a judge ordered him to file but he was advocating others to do the same.

The IRS cannot assess a tax without some form of acknowledgement that the accused had income. They need a return as proof. Without some form of confessional, they can't prove anything.

5) Don't ask for a refund.
This is another one of those things that will just pop up red flags all over the place. Consider that money as stolen. You were robbed fair and square. Don't expect the money back. Chalk it up as a learning experience. Somebody else who you don't even know received your money and probably already spent it (on lottery tickets). Hope that makes you feel better.

6) Don't sign anything under penalties of perjury.
The only way you can be accused of perjury is in court. You cannot perjure yourself outside of court. Anything that needs to be signed under penalties of perjury should bring up your own red flag. Whoever is asking for it is anticipating that it may be used in court. You don't want to go to court if you can help it.

7) Never represent yourself in court.
These days our courts are controlled by a little club known as the BAR. If you are not a member of this little private club, you will be shat upon at every opportunity. Since you are not a member of this exclusive club you are thought to know nothing. The judge will use all of his tools available, legal and illegal to keep you from winning. Objections will be sustained to your detriment. Your objections will be overruled. You will not be allowed to admit evidence in your favor.

Both Irwin Schiff and Larken Rose represented themselves. Both were shut down and found guilty of following the law. Both Irwin and Larken knew the law better than anybody in their respective courtrooms. Both were not members of the club.
