Quitting Social Security – How to do it

How do I quit Social Security? This is a very popular question and is at the heart of many who want out of socialist wealth redistribution.

The answer is both simple and complicated. First of all Social Security will not remove any names, numbers or any such thing. These are accounts we are talking about. Any good accounting system does not allow the removal of accounts that have transactions posted to them. That’s just good accounting practice.

The Social Security Administration likewise, has no means to quit Social Security. This makes sense as well. Let’s look at the procedures.

* To get a number, you must apply for it.
* To have taxes withheld and pay into the system, you apply using a W-4
* To receive benefits, one must apply for them.

Do you see the trend here? In order to do anything, one must make an application. It is all driven by applications made by those wishing to participate in the program. In order to stop participating all you have to do is to stop applying. There is no law requiring anyone to make any sort of application. It is by its very nature a voluntayr act.

If participation was indeed mandatory, there would be no applications. Everything would be automatic. You would get a number when you were born, there would be no W-4s and when you stopped working for some reason, checks would show up on your doorstep. We know this does not happen.

Theoretically, you can participate for a period of time, then decide not to participate for a few months, then start up again. That is only a theory however. Put simply, participation is not required. You can stop participating at any time.

There are many things to consider. This is where you substitute knowledge and wisdom. You have the knowledge; you now need wisdom to guide you. Since this road is not the most popular route to travel for the majority of the population, you can be met with resistance. Keep these things in mind when taking any sort of action. These are the things you need to do to stop your participation.

1) If you are under a W4 Withholding Agreement, this needs to be terminated.
2) Any business or entity that has your number, you need to remove it, or stop doing business with them. You will then have to find replacements for these. This includes banks, health insurance, utilities, communications (phone, cable TV etc.)
3) Burn your card (not necessary but will make you feel good).

You may ask, What about the Affidavit of Revocation and Rescission? Is it necessary? No, you don’t have to file the affidavit to stop participation in the federal welfare program. Take a look at what it is and does, then make your own decision.

The Affidavit is a multiple purpose document. For those that don’t know what it is, here is a brief synopsis:

The Affidavit of Revocation and Rescission effectively and legally removes your signature from your application for a SSN. It also removes your signature from any document with your SSN in dealings with the government.

You can easily create your own affidavit and send it off to the Secretary of the Treasury. There are samples available on the internet. Simply follow those examples and send it off, return receipt requested so you have proof that it got there. Make sure it includes your beliefs and understanding regarding Social Security, federal taxes etc. Put in as much information as you can.

The Affidavit contains statements that you have learned and believe. It contains such statements as:

“I was unaware that applying for an SSN via form SS-5 is a voluntary act and a SSN is not needed to be employed on the 50 states of the union.....”.

And;

I was unaware that in a court of law completed Internal Revenue Service documents signed under penalties of perjury can become prima facie evidence sufficient to sustain a defacto legal conclusion by a judge that the signer has voluntarily become a "taxpayer"…..

It can go on for many, many pages.

The document then challenges the Secretary of the Treasury to rebut the conclusions that are presented. It basically asks that if there is any incorrect information presented, show me where it is and tell me what is incorrect.

If any of the claims in the Affidavit are not rebutted, then the rule of presumption takes over. Anything contained in the affidavit may be presumed to be true and correct if unrebutted. It is my understanding that when an affidavit such as this is sent to the Secretary of the Treasury (The top of the heap with regard to Socialist Security), it is generally ignored.

Granted it’s not a nice feeling to know that something you have worked on for so long has been ignored by its intended recipient but, it’s a good thing. What is not responded to can be presumed to be correct.

You may want to send several of these. Send one with a cover letter asking them to respond within 90 days. No response? Send it again, give them some additional time. Do this as many times as you think is reasonable. What you are doing here is putting forth a good faith effort and giving them several opportunities and plenty of time to respond. If there is any incorrect information, it is their duty to point it out.

Keep a folder with a copy plus a copy of your cover letters, receipts from the post office and the return receipts. This is important. This could become evidence. Should you ever have to go to court for any reason, this then becomes exculpatory evidence. You have relied upon facts which you have given the government ample time to dispute.

Yes, you can quit Social Security. Stop applying and using the number. Everything else is a plus.
