Discover Card –

Let me give you a quick recap from the last issue. Last November I received an offer from Discover Cord. We had gotten into an argument which is very easy to do with a credit card company and I had stopped paying on it. This was my only credit card left. They offered me a 20% settlement. I didn’t have the money in November so they agreed to take a small payment in exchange for keeping the offer open until the end of December.

On December 29th I called them to make my settlement payment. They asked lots of questions including asking me to confirm a Social Security Number. I declined. They refused to take my payment.

After getting off the phone I thought for a few minutes and decided that I would make the payment as I had agreed to do. If they wouldn’t take it over the phone, I would pay it online. I did.

I wrote a letter to Discover Card explaining that I was unable to make the payment over the phone. I had made the payment online and to please credit that as the settlement payment. I also sent a message online asking if I sent it to the correct address.

I was looking forward to an argument here. I was anxiously waiting for a reply. I was about to send another online message wondering where my reply was when they sent me one.

They informed me that this was confirmation that the settlement was accepted as agreed. I was quite surprised.

I almost wish they hadn’t accepted it. Then I wouldn’t have had to pay them anything.

Simple Questions –

Many people don’t understand some of the simple rules that the Constitution has in it. Let’s take the first amendment for example. You ask and dumbed down government school graduate what the first amendment says, he will most likely state, freedom of the press, freedom of speech and separation of church and state. Separation of church and state is not entirely correct. The first amendment makes no restriction of the church. The restriction is entirely on the government.

The question remains, is the Constitution still the supreme law of the land?

I believe it is. It has been usurped and trampled on but it is still there.

Now, here are three questions that were sent to me a couple of weeks ago:

[1] Is there delegated authority, in the U.S. Constitution, to make or force, a Free Human, to Consent, as in signing their name, Yes or No?

[2] Is there delegated authority, in the U.S. Constitution, to TAX the Rights "We the People" have secured there, Yes
or No?

[3] Is there delegated authority, in the U.S. Constitution, to make or force, a Free Human, to Swear or Affirm, Yes or No?

Now, think about these questions next time you are tempted to sign any government form.

Don’t forget one of my favorite amendments to the Constitution, the Tenth:

The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved for the States respectively, or to the people.

This means, if it isn’t listed in the Constitution, the government does not have the power.

This leads me to the question, where in the Constitution can the government be in the insurance business? I have an idea what the government would say to that question. They would claim that it is covered under the “general welfare” clause and it is in fact not insurance.

I would agree, it’s not in actuality insurance. It looks, sounds and smells like it, it even has “insurance” in it’s name. The “I” in FICA stand for “Insurance”. But it is not insurance. It is missing one thing, a contract. There is no contract. To be insurance there must be contract stating that the covered person pays a certain amount in premiums. Then, if or when certain criteria are met, the contract would pay the insured whatever the contract states. With Social Security, there is no contract.

In my opinion, it is not covered under the general welfare clause either. The intention of that clause was for the building of such things as bridges, docks, harbors, tunnels and that sort of thing. The general welfare clause was never intended to give checks to people.

I apologize, I sometimes go off on tangents. Hope it is good reading anyways.

42 USC Sec. 408 provides that: Whoever ... (8) discloses, uses, or compels the disclosure of the social security number of any person in violation of the laws of the United States; shall be guilty of a felony and upon conviction thereof shall be fined under title 18 or imprisoned for not more than five years, or both.

The Privacy Act makes it unlawful to require a SSN unless it is specifically required by law.
