SSA Conundrum

I went to www.ssa.gov and asked them two questions:

What law required the giving of a social security number and what would happen to the employee if he refused to give it?

SSA responded:
...aliens...those making application for Federal Funds...(they gave the entire section)
But they said that the employer would be fined for not providing the employees social security number.

I pointed out the inconsistancy (i.e. no number required to work but the employer will be fined because the worker never bothered to get a number???)

The SSA responded, after talking to the Technical Supervisor, that they don't know, that there have been so many amendments that they can't find it, and that I should ask my congressman.
